ARTICLE 1 - AVAILABILITY
prestinet.com take on a commitment to provide to the user, an electrical continuous supply and a connection of the internet network 24 hours a day and 7 days a week.

prestinet.com take on a commitment to implement conditions of reasonable protections to protect the site(s) of the client, in particular as regards surveillance, security, temperature, dampness and electrical supply.

In the event of power cut or network failure, prestinet.com take on a commitment to implement everything to bring again into service as soon as possible.

If the deadline of pull up exceeds 4 hours, prestinet.com will give a financial compensation to the user which corresponds to one month of hosting.

prestinet.com will not be able to be responsible of malfunction falling to the site of the client, of his softwares or how he uses them.

In every case, prestinet.com will not be responsable for a sum superior to one month of hosting.
All claims will have to be done in writing within 30 days.

ARTICLE 2 - RESPONSIBILITY OF THE CLIENT
2.1 The client must buy, operate and keep his hardware (computers, modems, ondulators..) which are necesary for the use of the prestinet.com server.

The client is the only responsible of the functioning of his site and softwares and prestinet.com will not be responsible in case of malfunction of the site of the client or of his softwares.

2.2 The client takes on a commitment to broadcast information on his web site, hosted at prestinet.com, only in the limit entitled by the law and international rules in force, and takes on a commitment to take full responsibility
for it.

ARTICLE 3 - INTELLECTUAL PROPERTY
The client takes on a commitment to broadcast, upload or convey in the server where he is hosted, only informations and datas which are not protected by no right of intellectual or industrial possession, nor all other privatory right (datas belonging to public domain) or for those the Client got an express authorization of the holders of these rights for using, uploading, transmission on internet.

Every transmission, broadcasting or representation, via the servers of prestinet.com, by the Client, of informations or datas are done under his only and full responsibility.

ARTICLE 4 - RATES
The present engagement is done against a monthly rent defining in the contract of hosting.

When the Client will have choosen his option of free hosting the first year, his only obligation will be to put on his homepage, a banner.
What is the return asked for prestinet.com for the hosted site.
see: free hosting during 12 monthes.

After one year of free hosting, the client is free to host his site on another server than prestinet.com if he wants.

We will claim no indemnity for that.

The Client will have to notify prestinet.com the eleventh month, that is 30 days before the due date by Mail, fax or registered lettre.

If the Client wants, after 12 monthes to keep the hosting of his site in the servers of prestinet., the hosting will be done against a rent defined in the section Hosting.

The cost of the onthly rent is defined in the contract of hosting.

The owner of the hosted site , takes on a commitment to prestinet.com to do a quaterly payment in advance.

prestinet.com. reserves the right to modify its tariffs of hostings, respecting a notice of 60 days and getting the written agreement o the user.

The sums which are due by the user, after reminder stayed without effect, can be increased by interests of delay from the date of production of the unpaid invoice, on the basis of one and a half times the interest legal rate.

In case of unpayment by the cliente of the sums due to pretinet.com and after reminder stayed without effect, prestinet.com reserves the right to stop its services immediately.

ARTICLE 5 - COMMITMENT OF THE CLIENT
5.1 The Client takes on a commitment to host his site on the server of prestinet.com for one year minimum, whatever the option:
* Free hosting for 12 monthes,
* Or after the 12 frst free monthes:
When the client will be hosted, against costs and conditions of hosting of prestinet.com.

After the passing of this notice, he can terminate this contract when he wants.

However, he will have to inform prestinet.com by mail with acknowledgement of receipt at least 30 days before.
